GENERAL TERMS AND CONDITIONS (IN ADDITION TO EACH OF THE SPECIFIC TERMS AND CONDITIONS ABOVE)

1. Who Are We?
   
   1.1 Each Free Prize Draw above (referred to in these terms and conditions as the "Free Prize Draw") is offered to you by Figleaves Global Trading Limited. We are a company registered in England and Wales under company registration number 03060702 and our registered office is at 5th Floor Alder Castle, 10 Noble Street, London EC2V 7QJ. Figleaves Global Trading Limited is the company that in these terms and conditions is called "Figleaves", “we” or “us”.

2. What terms, conditions and rules apply to the Free Prize Draw?


These terms and conditions apply to the Free Prize Draw. Any persons who breach them may be excluded from access to the Free Prize Draw. These terms and conditions are between Figleaves and account holders of Figleaves who are eligible for entry into the prize draw ("Entrant", "you").


3. Updates


3.1 It is your responsibility to read and understand these terms and conditions.

3.2 We reserve the right, from time to time, and at our sole discretion, to change or update these terms and conditions.

All changes to these terms and conditions will be published on our website www.figleaves.com/uk (the "Website"). Upon publication, each change will become effective and you will be deemed to be aware of and bound by them. You should therefore review these terms and conditions regularly to ensure that you are up-to-date with all the current terms and conditions.

3.3 If you do not understand or accept all of these terms and conditions then you should call our Customer Services team whose contact details are set out above. If you do not agree to all of these terms and conditions and do not wish to be bound by them, you can request to opt-out of the Free Prize Draw as set out in further detail in point 7.5 below.


4. Who may enter the Free Prize Draw?


4.1 The Free Prize Draw is open to:


4.1.1 all permanent residents (best defined as the place where they principally live and where they pay taxes) of England, Scotland, Wales and Northern Ireland;

4.1.2 who are aged 18 years and over;

4.1.3 who are account holders of Figleaves; and

4.1.4 who purchase a relevant Qualifying Product within the Qualifying Period (see specific Terms and Conditions above). Any purchases received before of after this period will not be entered.


4.2 The Free Prize Draw is not open to employees of Figleaves, their immediate families (immediate defined as; children, parents, siblings, partners, spouses of the employees) and those professionally associated with this Free Prize Draw.

4.3 Decisions as to eligibility to participate in the Free Prize Draw shall remain with Figleaves whose decision shall be final and binding. In the event of any fault, misunderstanding, mistake or dispute concerning the operation of the Free Prize Draw, our decision as to how the matter shall be resolved shall be final.


5. Entry


5.1 Each time you purchase a Qualifying Product within the Qualifying Period, you will automatically be entered into the Free Prize Draw.

5.2 The time of transaction, as recorded by Figleaves servers or servers acting on behalf of Figleaves, will be deemed to be the time of entry (and therefore whether the entry is within the Qualifying Period).

5.3 We accept no responsibility for incomplete, delayed or lost entries as a result of technical failures.

5.4 There is only one entry per transaction, however, each transaction for the purchase of a Qualifying Product will result in an entry to the Free Prize Draw.

5.5 If you do NOT want to be automatically entered into the Free Prize Draw for any reason, you can opt-out by notifying us at competitions@figleaves.com and you will not then be included in the Free Prize Draw. Details of this opt-out process will be displayed at the point of purchase of the Qualifying Product. If an entrant opts-out after having been selected as a winner, the winner selection process will be carried out again and a new winner will be chosen.


6. Winner Selection


6.1 The Free Prize Draw will be held after the Qualifying Period and a winner will be selected at random by a computer-generated system. A Figleaves employee will witness the winner selection process. This witness will also screen all winners for eligibility. We reserve the right to seek proof of age and identity to ensure compliance with the entry conditions. No correspondence will be entered into and Figleaves' decision will be final.

6.2 The winner will be notified within 28 days of the end of the Qualifying Period. If after reasonable efforts have been made we cannot contact the winner, a new winner will be selected at random via the method above from all eligible entrants.

6.3 The winner will be announced on the Blog. The winner's details can be requested by writing to us referring to the name of the Free Prize Draw at our address set out above.


7. Prize


7.1 We reserve the right to offer an alternative prize. Any substitute offered will be of comparable value to the prize substituted.

7.2 We have no liability for any prize which is lost or stolen or fails to reach the winner where this is beyond Figleaves' control.


8. Personal Details and Publicity


8.1 We will use your personal details to operate the Free Prize Draw. Where we or other companies in our corporate group want to use your personal details for other purposes (such as marketing) we will offer you the opportunity to agree or to refuse this.

8.2 Your personal details will be treated in accordance with our Privacy Policy from time to time and in accordance with the law as it relates to people’s personal details.

8.4 If you are the winner of the Free Prize Draw you agree that you will allow us to use your name and picture in marketing and publicity undertaken by us, which may be in more than one country and which may be in a number of media, for example, print, television, internet. We will pay your reasonable expenses if we need you to make yourself available to be used in marketing and publicity of this sort.


9. How far are we liable or responsible to you?


9.1 Nothing in these terms and conditions removes or limits our liability for fraud, for death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law. These terms and conditions also do not affect the rights that are granted to you as a consumer by the law. Otherwise, we will not be liable to you for any matter relating to the Free Prize Draw offered by us.

9.2 We will also not be liable to you if you suffer loss or inconvenience because of the failures of persons or systems that we do not directly control – for example, mobile phone network operators, internet service providers, software providers and telephone traffic handlers.


10. Legal position of the Terms and Conditions


10.1 These terms and conditions form a legally binding agreement and by entering, Entrants will be deemed to have accepted and agreed to be bound by these terms and conditions.

10.2 These terms and conditions shall be governed by the laws of English law unless you live in Scotland in which case Scottish law shall govern, and are subject to the exclusive jurisdiction of the courts of England, Wales, Scotland and Northern Ireland.


11. General


11.1 If any provision of these terms and conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions, shall be enforced to the fullest extent allowed by law as to effect the intention of the parties, and shall not affect the validity and enforceability of any remaining provisions.
